Even though drinking is legal for adults 21 and over, there are many adults that do not drink. To the same, now with marijuana legal, still many people will never consume it. For some it is a religious endeavor to keep themselves unfettered by drugs and alcohol, others just simply don’t want to try it. However, because of some clever work in biology and pharmacology over the years, there are now different forms of weed out there that will not get you high, or at least not as high as the real stuff.
CBD and Delta-8 THC
One of the key chemicals compounds in marijuana that produces a “high” effect is called Delta-9 THC, or tetrahydrocannabinol. This is one of over 113 cannabinoids that are present in pot. When I say pot, for the purpose of this article, I also mean Delta-8 THC and CBD. I have lumped them all together because when used, they all will in most cases draw a positive result for marijuana on a drug test. That’s right, even the stuff that was legal before the legalization of marijuana in NYS, CBD, the harmless thing you give to your dog when there is a lightening storm to help them fall asleep—that may show up on your drug test.
The Drug Testing Dilemma
Each company has their own policies on drug screening, and they reserve the right to test for whatever they would like, so long as the employee or prospective employee consents. However, as stated in a previous blog, “[NYS] employers cannot discriminate against, fire or refuse to hire employees due to a positive result on a pre employment cannabis test.” As this is a brand new law in New York State, employment drug testing will take some getting used to for companies that have made hiring and firing decisions on this in the past. There are some exceptions to this rule—police and peace officers, CDL drivers, people who supervise children, and any position wherein drug testing is required by federal or state law.
Why the Positive Result?
If you have consumed Delta-8 THC or CBD and you have an upcoming urinalysis drug test in Buffalo NY or wherever you work, the results will likely come back positive for marijuana use. But why? Drug tests in general, whether the lab uses saliva, urine, or blood, look for indications that a drug has been in your body. When our body metabolizes food, alcohol, drugs, pretty much anything, metabolites are left behind for a certain amount of time. These metabolites show what we have consumed. Drug tests, especially 10 panel drug tests, do not test specifically for Delta-9 THC (the psycho-active ingredient in marijuana), they simply test for metabolites of THC or other cannabinoids, which may be any of the 113 possible compounds within marijuana and CBD products.
